A: The escrow agreement should say what proofs the buyer needs to present to get the escrow released. If there is a dispute as to the escrow and the escrow agent is getting conflicting instructions from the buyer and seller then the matter needs to be decided by a judge. Normally a real estate attorney’s representation does not include post closing litigation so buyer would need to pay another fee or go to small claims court and represent himself/herself.

Regarding damages found post closing normally the seller would give the buyer the $500 PCDA credit at closing. In these cases unless buyer could show the seller commited fraud or the repairs were covered under the escrow agreement buyer may have to seek recourse from the inspector who did inspection report.
